Memo. 2012-79, 103 T.C.M. Numerous badges of scams show that Duong intentionally evaded the payment of taxes he knew to be owed. He understated his income for both full years in issue. See Stone v. Commissioner, 56 T.C. See Ark. Oil & Gas, Inc. v. Commissioner, T.C. Memo. 1994-497. The revenue was given by him as agent inconsistent explanations, proclaiming falsely that neither business received cash obligations from customers.
At trial he contradicted himself by proclaiming, implausibly, that AK Nails customers sometimes paid in cash but that Perfection Nails customers never did so. Duong also failed to cooperate with tax regulators. The revenue agent requested bank statements but received them never. Eventually, the revenue agent had to summons the bank statements. See Good v. Duong regularly commingled business and personal money, as the bank deposits analysis made clear.
